Dilapidation’s

Objective:

Prepare a terminal schedule of dilapidation’s in accordance with an upcoming lease expiry date.

 

Outcome:

Acting on behalf of the Landlord, AMC were appointed to undertake a pre-expiry schedule of dilapidations inspection and prepare a Terminal schedule of dilapidations. Undertaking the survey within this time frame enabled the tenant an opportunity to respond to the claim and address any and all identified breaches.

Following formal service of the schedule, the tenant confirmed they had appointed a surveyor to act on their behalf with confirmation then received that the tenant was to undertake elements of the work themselves.

At expiry AMC undertook a post expiry re-inspection with the tenant’s surveyor which confirmed not all breaches identified had been addressed. Due to the failure by the tenant to comply with all of their lease obligations, AMC then arranged for all outstanding and sub-standard work which had been undertaken to be completed and remedied with the outstanding cost charged to the tenant by the Landlord.

Although contentious, this approach ensured that our clients property was returned in a condition consistent with the terms of the agreed lease, and prevented the condition in which the next in going tenant takes occupation to be a lessor standard than previous, which can have long term effect on quality, expectations and potentially rent.
